Summary: This is first reading of an ordinance amending Chapter 7, Buildings and Building Regulations, of the Code of Ordinances.  Upon review of the new Kentucky Building Code (KBC) regulations it was discovered that there is a conflict in the ordinances.  In Chapter 7, Buildings and Regulations, Article II, Building Codes, the city adopted the Kentucky Building Code regulations and in Article V, Property Maintenance Code, the city adopted the International Property Maintenance Code (IPMC) regulations.  These regulations have a conflict on protective barrier regulations relating to aboveground pool/spas.  Also, the new KBC exempts above-ground pool/spas from requiring a building permit.

The proposed ordinance reflects the Board of Commissioners desire to omit the protective barrier provision from Article V and follow the KBC regulations in Article II with the addition of safety barriers for ladders and/or steps used to enter the above-ground pool/spa and a requirement to have a Building Permit issued so that Code enforcement personnel can review the location to ensure that it will not be located in a Utility Easement or other location interfering with utility service.

Status:  The City of Henderson will hold a meeting August 14, 2018 at 5:30PM.
