New Department of Justice Clarifications on ADA Regulations
APSP has reported on the pending March 15, 2012 compliance deadline for accessible pools and spas for over a year, providing FAQ documents and continuing education. The industry, along with facilities required to comply, have been working to understand the new requirements for pools and spas and ensure compliance by the deadline.
On January 31, the Department of Justice, the federal agency charged with enforcing the Americans with Disabilities Act, issued a technical assistance document that provides clarifications on accessible pool requirements. Aspects of this document have raised questions and concerns from those who install accessible means of access into aquatic vessels and the facilities themselves who are charged with complying with the ADA guidelines. APSP is working to meet and inform the DOJ of our position which is to allow use of ALL options that exist on the market, as long as they meet the 2010 Accessibility Standards.
